Ex is lying on his financial statement... STILL>

Okay so it has been almost a year since this whole court mess started.  My ex and I both had to submit a sworn financial statement.  We did however my not so bright ex stated in one of our many court hearings that he had got a raise in his income.  So ofcourse my attorney picks up on that statement made by ex and asks that he submits his tax return for 2008 and his most recent paystubs.  This was in January of this year 2009.  We just had our last court hearing this past July and still did not have the returns or stubs.  At the end of the hearing my ex's attorney says he's been trying to get my ex to submit the information and he will have a new sworn financ. statement by the end of business day and the tax returns and stubs by the end of the week.  The financial statement came in however it was not any different than the first one except this time my ex is saying he was paying our mortgage and his rent payment.  Our house just forclosed on 09/02/09.  Any how my attorney got fed up with this and filed a 'Motion to Compel' and the court granted it.  My attorney said that my ex will now have to supply the return and statement because the court has ordered him to do so.  I am just wondering if he doesn't comply with this what will happen to him?  And how long can the courts go on not realizing that he is lying on his financial statement?  I mean he makes almost $20k more a year than I do and he is saying he takes home a net pay of $800. a month but paying $800 in rent and $1400 in a mortgage not including other bills.  I am so lost in this.

At least your lawyer is on your side trying to make things happen.  Mine just says, oh well he has complied close enough.  No info on his financial statements are supported by actual documentation.  I repeatedly ask for it but a year later my lawyer is telling me he will not seek any thing more. 

It appears nothing is done because courts are so overwhelmed. Those who care little for the rule of law get away and those who respect it are burdened to keep to the letter...

If he doesn't submit his correct information he will be in contempt of court and he could be fined, as well as have to pay a portion of your attorney fees. In rare instances, someone is sent to lockup for 24 to 48 hours to show how serious the court is.

You have to understand that there is only so much a court can do to force someone to do something....you may have to end up hiring a forensic accountant or your attorney may have to subpoena the hr department at his work to get his income information.
