Marriage in Foreign country, Divorce in USA

Hi,

I am a Indian male citizen, currently I am in new jersey married to a US citizen.
The marriage happned in India in Dec 2007 according to Indian Hindu Act.

Ever Since marriage we have been living separately and its more than 20 months we have not been together
We have NO kids.

I would like to file for a "uncontested divorse". My spouse is currently in India

My case question

1) Can I file my divorse in USA even if I got married in India to US citizen?

2) We are living separately for more than 20 months. We dont have any joint account. I have filed my taxes single and our residential address has never been together. Is this good enough to prove that we are separated and make a ground for "uncontedted divorse"

3) How much will your firm charge, if I file through it?. how long can it take to settle?

4) is my case strong for "uncontested divorse". Can my spouse contest it for any reason?

well first off, I'm in California and don't take NJ cases, you'd have to find an attorney there.

Sure you could divorce here - but the fact of the matter is, your divorce would NOT be valid in India unless it was mutual consent (and you registered it) - so you would be better off seeking to end the marriage in India if you think your spouse would contest it.

if you don't live together, never have - why on earth would your spouse have a problem with divorcing?
