MODIFICATIONS AND VISITATION

okay so i filed a motion to show cause for a modification of my ex's parenting time. he has a safety plan and is moving to another state... my court date is 3.5 months away he is moving in 30 days do I have to give him visitation in the same manner or can i say no... not until this issue is resolved it is a safety concern he is a alcoholic.HELP

i dont think he can move unless he is giving up custody but he focas is not his kids its his addiction keep your  kids safe

Okay so what I am understanding is the following ;
after i serve my ex husband the motion to show cause for modification i can legally with hold overnights he is moving 8-12-09 which is less than the 45 days he has to stay here he's moving to another state but we have a stipulation he cant leave the metro area i am offering him the same days of visitation only they are day visits. within the metro area I need to make sure I will not be in contempt like he is going to be......can anyone answer this?

A custodial parent can't move, a non custodial can...

You offer reasonable supervised visitation at your home (or public place nearby) that he can come to until such time as a new permanent visitation schedule is established. That will cover you until the court date - you CAN'T not let him see the kids - but you can control it.

I am wondering what spaz says too she is brilliant she has helped me so much when i was going thru my divorce....... so you think he can tmove when there are papers on file? well let him move then.......

From what I understand no one can move as long as there are temporary papers on file and you are waiting for the final date.  The fact that you said you are trying to modify tells me you have that preliminary paperwork.  I think that puts him in contempt and you don't have to stick to the visitation.  I might be wrong.  I'm curious to see what people like spaz and others say.  Hang in there!
