File in two states?

My stbx filed in a state (AR) that neither of us were ever a resident of during our marriage.  I've never lived there, he had just been there 2 weeks.    I have a lawyer in that state filing a motion to dismiss and I am pushing perjury charges as there were more than two blatant lies that he swore and signed on.

My question is can my lawyer file in my state (SC), as this is the correct state that should have jurisdiction, before the other case is fully dismissed?

For shits and giggles, when his attorney was asked on what grounds made me avail myself to protection of state of AR hence have jurisdiction , his answer was "she drove on our streets".  WTH?!   If that's the case I've driven across country a few times so I can get divorced in all states I drove thru!

Sorry, been super busy this week - yes he can file in your state - if for some reason the judge in AR balks at the dismissal the two judges can speak....doubt it will be an issue tho.

My grammar really sucked on that last response but I'm sure you can figure out what I was trying to say.  I need to concentrate more on the typing and less on the ice cream.  Sorry.

I sent spaz a dmail and apparently she is super swamped.  She sent me a quickie answer, so maybe send her a quick dmail.  It may take her awhile to get to blogs.

LOL about the STD thing.  That is hysterical.  My had to re-consider my oldest daughter's name when I realized her initials would be A.S.S.  We had to use our initials at the bank I worked out to log onto the computer or I would never had thought of that until it was too late.

Thanks, once again, for making me laugh.

STD (oops, did you think about that when you created that tag name? haha)

Yes I think in AR it's like 60 days.  He was only there for like 2 wks when he filed.  His parents didn't even move there 'til June 09 so he's way off base.

Plus he said date of sep was Feb '09, NOT.  It was May '09.  Got our plan tickets showing we were out of the country together, living under one roof.  He didn't get back to US til mid-June.

I was hoping Spaz would've chimed in to see if while this is going on in one state, if I could file in my state in the meantime.

Thanks for your comments!

If that's the case LIP then I would find out which state has the best laws for you and file there.  Heck, this could work to your advantage!

Read my latest blog, I might be making the biggest mistake of my life but I think I will finally be able to sleep at night.  BTW, looks like I'm gonna have to get my gall bladder out.  If it's not one thing, it's another.

Don't you have to file in the state and county where you are a resident for at least six months?
