Waived "something" during prove-up but signed nothing....

My ex had agreed to let me take our kids out of state so he would not have to pay maintenance to me. However, between signing our papers and prove-up he heard from a third party that I was moving in with another man, etc. Needless to say it was all false. He tried to file an injunction from me taking the kids from the state, but after finding out his source was less than truthful we ended up getting divorced in court that day. However, my attorney and his attorney talked and then my attorney said that I would waive the fact that IL retains jurisdiction over the kids for 2 years vs. 6 months and also the burden of proof for the "best interest of the children" was not as high as it usually is those first two years. When I got my final documents from my lawyer, he just made mention in his cover letter that it was on "court record", but didn't elaborate or anything nor were there any signed copies, etc. in my packet. When I asked him for further clarification he said that there were no more papers that I needed and then he was upset as I asked for more information. My question is this, how hard would it be for my ex to get me to move back to IL, and wouldn't it be REALLY hard to show "best interest" of the kids? I am a faculty member at a University, my kids are in a private school, enrolled in sports, etc. and they are only 4 & 5. Is there really any easy way he can get me to come back? I think that I'm still reeling from the first time around that I'm just worried I will have to go through it again. Am I worrying about anything? Or just causing myself angst? Any thoughts or insights would be much appreciated!

If he was going to try to get you back to IL, you would know it by now - he already tried once and it didn't work...

"on court record" means the court reporter transcribed their discussion and agreement regarding your move, and if your ex did try anything, that would be brought up and any further motion would be dismissed like before.

 

So yes, you are causing yourself angst for no founded reason. =)
