Ex stops payment to me and send to our dau

My daughter is with my son for the summer. Her dad decided to send her the money he is suppose to send me. She stayed with him for 2.5 weeks as a cooling off period between her and I. He says he was told by the child support office that he could file for child support for the 2.5 weeks. He told our dau I'm to send her twice the amt he sent her and now she's mad at me b/c I won't send her that kind of money. Its court ordered and it is sent to the state and the state direct deposits into my account. Can he do this?

Thanks for your reply.

I will contact the Child Support Enforcement Office. Our dau stayed with her dad for 2.5 weeks.  Then when she came home I flew her and her infant to be with her brother for the summer in which I doubt she will stay the entire summer.  Her dad has baited her with the reward of staying in his vacant apt until lease is up in Jan. Then what?  He just want a reason to stop child support and her moving out of my house would be his ticket. Sad.

Contact your local child support enforcement office - they will assign a case worker to you.

I don't have a caseworker. Our divorce was final Jan 09. We both had attorney's. He sent an email asking if I could write the state a note (notarized) stating I no long need support so that he and I can come to an agreement as to what each other would pay. NOT!  Says if I don't respond he will file for child support.  Well he can go right ahead.

Nope - he is contempt and any money he sent to your daughter can not and will not be counted as child support. He still owes you. Also, no he can't file for child support for those weeks, he didn't have her with him...you were in control of where she was...not him.

 

Contact your caseworker.
