if a court ordered evaluator tells you to jump, you do it - it is 100% legal - just remember, you invited this evaluator into your lives, so the consequences of it are kinda on you. (sorry, don't mean to sound unsympathetic - I realize it has to hurt not getting to be with your son)
The problem is in where the case is being heard - and since it was filed in CA, the fact you moved (reassigned or by choice) you lose out. If you were still in CA, seeing your son wouldn't be an issue - but now you have to deal with out of state custody & visitation issues...they tend to lean towards children being away for bulk periods of time...you are unfortunaltey getting a taste of it sooner than expected. You have a complicated case - and this investigator is doing a very thorough job to ensure the best possible outcome for the child in the long run.
