how to sell my house without my husband???

my husband wont sign the quick claim he offered and i told him just sign to put the house in the market. i mean to sell it together not as a quick claim anymore.

 

its so difficult to get in touch with him that if he finally signs to sell, then the hassle its going to be to get him to sign if we find a buyer.

 

im sick and tired of this...i want him out of my life...i found a lawyer but at the moment i only have 19 dollars in my acct and home bills to pay plus food to buy, i cant even pay his fees to start anything...the lawyers tell me its not worth doing it the legal aid way or using the do it yourself either bc its too much at stake...

 

what else can i do??? i need a way out!!! i feel so trap!!!

A judge has to grant you the right to put the house on the market on your own - or your stbx has to be a part of it - you can't do it yourself, he has rights to equity and say & he can stall on the disposition of the house until a judge makes the decision if he so chooses.

You can't take his name of the loan but you can do a quit claim deed without refinancing.

If his name is on the house...you cannot sell it without his signature. If he is on the mortgage...you cannot do a quit claim deed without refinancing in just your name. You really need his cooperation or to have a judge order certain actions.
