kids custody

i need to know how does the custody side of the divorce works.

 

my husband overdose on many different drugs saturday morning. he fell in the shower and cut his eyelid and was bleeding a lot. i took him to the emergency room and today he is been transfer to another hospital for evaluation. the problem with this is that last yr he was taken there and release within a few hrs.

 

bc is done through the baker act, he is only going to be hold for 3 days and that's if he stays.

 

for obvious reasons, i dont want shared custody. besides violence in the house and the drugs, its been a horrible roller coaster for my children. he's driven drunk or high with them in the car, he's been twice to rehab.

 

i have some records of his actions but not a lot. im not sure how to do this. my daughter is 10 yrs old and she deserve a better life!

pd: how can i find a lawyer that would work probono???

Your case is going to be too complex and other than if you qualify for legal aid (check with your local court house) you won't find anyone who will take your case for free.

Gather up what evidence you have and sit down with some attorneys who give free consulations and see what they have to say about your case. See if you can get a loan, max a credit card, borrow from a family member etc to pay for legal representation. (if you don't qualify or legal aid) go through the phone book and talk to every attorney you can until you find one who will work with you, and your budget.

I'd imagine you have grounds for sole custody with him having supervised visitation - but bear in mind the court can order him into counseling and evaluations to help him get past his issues so he can exercise more parenting at a later time.
