Custody question please help! :]

i am 14 living in california with my dad who has full custody and my mom is moving to tennessee so she can be closer to her parents and i wouldlike to move with her, but my dad says no. i was wondering if i can go to court and ask them if i can move woth my mom. my parents were granted 50/50 decision making if that helps me.

sorry didnt mean to get your hopes up. I had no idea that GA was the only state that did that. Good luck to you and sorry about  your situation.

Hi sweetie, I'm sorry, but no, if your father has residential custody - he has more say than your mother does - they would have to go to court and your mom would have to prove why it would be better for you to be in TN over CA, and that won't be easy (or cheap) to do. How you feel about it doesn't matter to the court at all - there is only one state (Georgia) that allows for a child's say to matter. You will have to wait until you turn 18 to go.

 

It's sad to hear that your mother is not willing to try to make things work for herself to stay in CA close to you.

I know that in GA once you're 14 you can choose who you live with. That is what happened with my parents divorce. I went to the lawyers office and signed a paper that I wanted to live with my mom and I was 14 then. I dont know about california though.

have you talked to your parents about this?  you should start with them.  talk to them about why you want to move with your mom and see what they have to say.

do you have any reason to believe that they wouldn't agree with you?
