In NY - Cruel and Inhuman tx, Adultry or just vanilla seperation??

Im filing for divorce in NY. We have been UNofficially separated for 3 weeks. 
My initial thought was to just do a legal separation agreement and wait one year and roll it over into divorce. No fuss. No drama. No fault.

I also hope to do collaborative divorce. But, the more time goes on, the more egregious my HB behavior is getting and Im thinking its not going to be a possibility that we get thru this with logic, kindness, fairness and reason.
My HB is messing around and I have been quiet to him about my knowledge of this. I am leaving him alone to go about his business keeping my eye on the fact that I want out anyway and that him fooling around will keep him out of my hair. But, Im worried about my rights should things get nasty.  Should I bite the bullet and spend the money on a PI to get pics and evidence?
I have a case for cruel and inhuman too.
I guess my main objective is my kids. Will filing for cause - adultry- help my divorce/custody case?

Yes, Im fair with visitation. I just want to make sure I dont waive any rights.

Ana,

You need to consult with a divorce attorney right away. In some states all debt and assetts are considered community property and any debt he is accumulating right now is also 1/2 your responsibility. They can also advise you to other legal ramifications. Please go see one soon and protect your rights as soon as possible.

It won't help with custody...it will possibly get you more money if you can prove he was squandering marital assets on his paramor(s)...but...as long as you file first, you can start off in the "no fault/collaborative" ring and use your knowledge as leverage to get what you want - threatening to change the grounds to fault if he doesn't go along with what you think is reasonable.
