not signing papers

if ur spouse says he wont sign papers, is there a law that after a certian amount of time the court can do the divorce w/ out him signing off on it?. . . im in north carolina....

The divorce laws are state-Specific, I Live in CA> This is a no fault state--that means regardless of who is at fault--Both parties are granted Divorce,even if one of the party is unwilling to go through it. So once divorce is filed with the court--the other party gets a 30-day time period to respond(Ie:say that I am aware of this proceedingt with our marriage), Not responding within the 30-day peiod automatically grants the orginal party(The one who filed first) a default divorce,and the divorce will be granted ,but on his/her terms and the respondent wont have any say in the matter. It is in the respondents best interest to repsond within the 30-day period,that way the dvorce proceedings can take its natural course...and is not based on any one aprtys biased terms. SO its best to find out what your state does in cases like that. varsha
