Alternate schedule or 1st, 3rd and 5th weekend of the month

We have been on the every other weekend schedule. Last week  he had the kids.  Yesterday he sends an email stating it is his weekend again, because it is the 1st of the month weekend.  I beg to differ.

 

Can someone look at calendar and tell me if I am correct?

 

If that is what he wants to do can you please tell me what his weekends are so I can get the hang of this...

If the divorce decree states 1st, 3rd and 5th Friday it is not every other weekend. I don't think he is trying to dick anybody he just wants to see his children as much as he can just like the other parent. Seems like a lot of dad haters here.

A good thing to do is once a year get two calendars and color in all the days you each have the kids and send one to the ex. If you both agree just go by that calendar the rest of the year.

My divorce decree states:

...He shall have possession of said children the saturday following the 1st, 3rd, & 5th Friday of each month...

sounds wordsy, but all it really means is that you ARE on an alternating weekend schedule--until you run into a month that has a 5th weekend in it--in that case, he would get the 5th weekend, and also the 1st weekend of the next month. Back-to-back weekends every so often. It sucks, I know. The courts do it that way so that you can keep track of whose weekend is whose. But it can actually be more confusing if noone is keeping track.

Unless your possession order says something different--then you will probably want to clarify it w/ your attorney.

Geez, every other weekend does not mean set dates, he needs to get a grip! If he had them last weekend its yours, he gets them the next one! Unless it is formatted otherwise!

Looks like he's playing the number's game.   I think he's counting full weekends (including Saturday) that count at 1st, 3rd and 5th.     Just another way he can be a dick if he wants to belabor the point.

I'm ok with it if that is what he wants to do but I need to know how the 1,3, and 5th thing work.....I hate him...ughhhh

If it's every other weekend then that is what it should be. He is just trying to manipulate more time and see if he can get away with it. Or it could be that in his mind he is totally correct. Stand firm and keep the every other weekend.
