Stupid ex husband wants $ from me

I'll try to keep this as brief as possible,

Ok, so I'm divorced now since july 08.

Ex agrees in the Marriage settlement to pay my health

insurance til sept. 08.  The funds are withdrawn monthly

from automatic payment from his checking account.

Ex does nothing about canceling this account, thus the

funds continue to be withdrawn monthly.

Now its Feb. 09, he complained about having to pay every

month yet did nothing about it. 

So, now 5 months later he tells me I owe him the equivalent

amount for the 5 month ($2500 my share)and that he is

going to take me to court to make me pay him.

My question is:  Is'nt it his responsibility, its his money they

are taking.  Do I have to hold his hand through everything?

Does he have a leg to stand on here?

Thanks so much, I've been through the ringer with this and

only see more of this kind of things in the future.

That will be my next question!

Just so you understand it - my answer is based on how a court would view it - it's your insurance - not his - you have to prove to the insurance company how you will pay it once the direct pull stops - they would have continued to try to pull it from his account until you set a different payment up with them. His bank has nothing to do with it.

If you are referring to me as "greedy", you are not aware
of my entire situation.
I'm referring to a man who had multiple affairs, cheated,
lied, emotionally and verbally abused me for years.  And
then took the cowardly way out of leaving after 14 years of my
loyalty and care.  A man who was (is) a alcoholic, left his
wife and child without any financial help and did'nt even
look back.  So for him to aid me in my financial crisis I feel
is just payback.  I was always there for him and then he just
split on me and his family.  Where is my compensation for
all the years of loyalty I showed him?

Wow, some people are so greedy.
He overpaid you by mistake - so you owe him the money back. This is basic first grade honesty.
If you went to a store and they gave you too much change what would you do? Give it back right? 
If you overpaid your electricity bill and called the company to say you made a mistake, would you accept it if they said, "Too bad. Be more careful filling out checks next time."

Yes,
we did discuss this monthly and he ALLOWED it to
continue because of his laziness and procrastination.
The account was in my name but withdrawn from his
personal account.  I have not received my child support
from him in Jan. 09 of a measly $350.00 so I believe this
is his way of getting back at me.  I do not have the funds
to pay him, so I guess we will have to figure this out.
But he's the DUMBASS for letting it go on this long!
And now I will have to pay for his (and mine) ignorance.
Now I feel stupid!!!!!!

wait, are you saying he knew he was overpaying all along and you two talked about it, but he never stopped it? 

it seems to me that the responsibility would be on his end to 1. cancel the insurance, since it's his name, right?  and 2. stop the auto payments, since again, his name/his account, right?

plenty of ex's over pay for a variety of reasons....maybe because they know that life is more expensive and kids expenses can't possibly be handled with a few hundred dollars a month...or maybe because they want their ex and/or kids to have access to more opportunities/funds.  it's the right thing to do, for sure.

maybe you can just talk to him?  tell him how you both knew, and it was his job to turn it off, and you're sorry you didn't push him to turn it off, but can't we just call it a day and move on?

callng in lawyers for such a short amont of money is kind of counter productive, no?

Logically thinking,... if you knowingly benefitted from him continuing to pay the insurance then you should pay. If you got your own insurance or payed the premiums for your portion then you shouldn't have to. He should have notified his benefit services dept at work that Sept '08 you would be dropped from his responsibility. That's what I did. I darn sure wouldn't wait for my ex to do it.

unfortunately you both dropped the ball. it was his responsibility to cancel the payments on his end but, at the same token you were required to notify you insurance provider of the courts' findings and protect yourself from this kind of liability. if the roles were reversed you would be inclined to at least attempt to be compensated. if you cannot prove that you made at least a reasonable effort to avoid the account being charged, you may be in trouble.

Sounds like it should be his fault that he did not cancel in August.  I certainly hope that you do not have to pay him.  Good luck!

He was only ordered to pay until Sept 08 - no, he did not have to cancel his account it was YOUR responsibility to contact your health insurance provider with a new way of paying the preminums.

You owe him the money he over paid.

First of all how would you have been able to cancel it?  Wasn't it in his name onthe account? Let him take you to court. It wasn't your job to keep him informed of the ending date and that he needs to cancel. It was his negligence that allowed it to be withdrawn. Don't let him bully you and make you think that his mistake is your fault.
