CONFUSING AND !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!???????????????????

Hey Everyone, My husband just finallly understand that i want out. It took allot of time and letters for him to finally realize it, but now he wants me to leave OUR home. He refuses to pay the mortgage (which i cant afford) and ruin my name and credit. He wants to lose it all. I dont have any place to go and I feel it is within my right to stay. I dont bother him I sleep in another room on the other side of the house, but he states that he does not want to see my face and he is starting to hate me. I need some advice on my rights.

I'm in the same situation. My lawyer says that I should not leave and wait for the pre-trial hearing for that decision to be made. However, if things get out of hand, violent or abusive in any way, that I need to make the 911 call and go from there. The bottom line is you need back-up if you leave before court. Otherwise you try to stick it out until the courts decide who should stay and who should go. Also, my lawyer has told me that the mortgages will need to be refinanced taking my name off of them. Hope this helps. I don't what state you live in and the rules are different , but talk to your lawyer and be careful!

I agree with Robert you should have a right to stay. I assume your name is on the mortgage as well. If he says he does not want to see your face he should move out. I would contact an attorney as soon as you can to find out what your options are. Usually an initial consultation can answer your basic questions.

I believe you have the "right" to stay, but it sounds like the level of animosity is pretty high. Do you really want to live in that environment? I would recomend you talk to a lawyer, and find out what your legal options really are. Since they do vary from state to state, I can't offer you any concrete advice. A lot also depends on property ownership etc. See a lawyer, It'll save you hassle later.
