Morality Clauses - Does the state matter?

I am horrified that my STBX ran off with another woman and is living with her and pretending like they are the happily married couple. Needless to say we have to get divorced. I have a 19-month-old son and my STBX has made a nursery for him in his new home with the mistress. He even invited me over to his new home to see the room. Ugh. How cruel and insensitive.

 

I've been trying to keep my son away from this woman since day one and my STBX could careless what I want. Is there anyway the courts can help me keep my son away from her until we are divorced? I live in MD. Adultery is against the law here. I believe it's a whole $10 fine.

 

I've heard of people keeping their children away from the mistress. I'm a good person and want to raise my son with strong morals and values. Something his father is clearly lacking.

 

Do I have any shot at getting this?

Well first off, until a judge orders you otherwise, you can choose to only allow him to visit with the child in your home, supervised. That will alleviate him having the chld around his mistress.

You also need to be the one to file for the divorce and cite adultery as the reason - you will need to prove it so if one PI didn't work out, try another one until you find one available. If you google maryland divorce infidelity a few PI companies pop up among the articles.

Morals clauses are more apt to be allowed in states that also allow fault grounds, yours does - and some states do have caselaw on restricting the non-custodial parent from having a child around a lover at all - but not forever - at some point you are going to have to accept he has moved on, and that there is a step-parent probability in your future.
