my soon to be ex and I were going to file together but we have been separated for 5 months

i would get an accountant. I think I'm going to have to file "married filing seperately" also as my STBX is a lying, cheating bastard.

Because I live in our home and have full custody I believe I am able to write off the interests and have the dependant deduction. Those are the kinds of parameters an accountant will want to know so as to file correctly for you.

You can check with the IRS on that one. Maybe your atty. can tell you. I haven't had to deal with head of household. My children are grown so I don't want to tell you something that might be wrong.

If you are still legally married you would have to file as married filing separately.
If you both agree you could file married and split the refund. Once you are legally divorced you would have to file single or head of household.
