Divorce and Bankruptcy

I have checked out all the bills and they are in my name only. Funny how that happens; I digress...I will have to file for a BK& to try to keep some of my money from leaving my pockets. The thing is and I know this will come as a shock to some of you but I don't want my stbx to be hurt by this. We get along somewhat better and she has been able to work on rebuilding her credit. We have both been through enough and have agreed on an ammicable divorce. THe issue is how can I protect both of us by filing a BK7 and keep her out of it so she wont be responsible after it goes through. By the way she has custody of our daughter and I want them protected as much as possible. Thanks for your time.

Not surprising - there are amicable divorces out there lol

If you don't want it to affect her - Get divorced first - ensure in your divorce decree she is not joint in responsibility of any of the debts you plan on adding to the BK.

Consult a BK attorney (as suggested) as there are much more strict laws on BK now, you may not be eligible.

Hi...I am just going through a bankruptcy, and I'd suggest you talk to a BK attorney about this in an initial consultation.  Should be free for you to ask that and get an answer.  Is she a cosigner on any of the debt being included in the BK?  Is she using one of the assets that secure a debt you are including (house, car)?
