Urgent: Spousal Support issue (California)

Quick question about length of spousal support (CA). legally separated in Jan 08 but dwelling on the same house until now. Husband has been paying

"Voluntary interim spousal support" on top of paying all expenses for the house. Now, as approaching to settlement, husband is willing to pay $$ amount of spousal support for next 3 years asking "credit" of payment of the year. Been married 8 years and by law he's supposed to pay SS for 4 years. What would court say?  Can wife ask for  4 years of SS from the time of settlement or should give him a credit? Want to know how would court see...

I have been legally seperated since June 07 and have been paying temp support. Are you saying that is I get divorced this June 09 (which wont happen - but lets just say it will) the I wont get credit for paying 2 years of support. If I have to pay , it would be for another 3 years. We were married 6 years. Family Law sucks for the inocent.
