Bigamy

what if you (the wife) had an interlocutory decree of divorce from a first husband, then you (wife) married a second husband but you and first husband never finished the divorce, had a final hearing and no final divorce decree or judgment was ever entered. Then, your first husband asks you to reconcile and he drops his original petition for divorce. Can the husband's petition be dropped at his request after an interlocutory decreed ahs been entered and six years have past? Also, then can I (wife) just ask for an annulment from the second marriage declaring it to be invalid if the first marriage lawsuit is dropped and that marriage is re-established? What if there is a child of the second marriage? If the first husband dropped the entire divorce petition, then that would be two marriages in effect at the same time, so wouldn't re-instatement of the first marraige then make the second marriage void? and qualify for an annulment?BTW, Me and my second husband are in the middle of a divorce suit and nasty custody battle and live in another state than my first husband does and my first divorce action is.

you do realize that your 2nd husband can bring up the fact you are a bigamist and walk away with everything, including custody of the child - and get you thrown in jail, right?

No?

Well, he can. So I seriously suggest that this whole line of thnking you are on, walk away from your second marriage by springing this fact you are still married to your first husband up be dropped like a steaming hot potato.

 

Get thought this second marriage divorce and keep your mouth shut about not being divorced from your first husband - then get your divorde final from the first....because if you don't - you are looking at jailtime for bigamy &  fraud.

Oh, and btw - I seriously suggest you settle with your stbx in a civil manner and fast, before everything comes and bites you in the ass - including 50/50 custody if that is what he is asking for.
