Dismissing a Divorce Petition

Can My ex-husband (petitioner) and i (respondent) agree and file to dismiss his divorce action, which initated over six years ago, in 2002, and one in which we got an interlocutory decree of divorce back in 2002? I thought the interlocutory decree was an interim, or temporary decree of divorce and I read somewhere else that it was for the purpose to give the parties a chance to reconcile and it could actually be reversed. We never finished our divorce, ahd afinal hearing or received a final decision from the judge on the dissolution, so does that mean it can be dismissed simply by my husband withdrawing his petition for dissolution of marriage? Can our interlocutory decree of divorce be reversed?

Angel -

In that you chose to commit bigamy in the interim - you will have to divorce your 1st husband after you divorce your 2nd husband and then remarry your 1st if that is what you so choose to do. IF you want to stay out of jail that is....

I'm sorry for the confusion. I was served with divorce papers from my husband six years ago, back in Oct. of 2002, and we had lawyers, went to a temp. hearing and the judge gave us an interlocutory decree of divorce. We went to one discovery & deposition meeting with our lawyers. At that meeting, my husband then asked me if I wanted to reconcile. I said no at the time. We let the divorce sit since March of 2003 or 2004 and we now want to reconcile. The case was left open at the court house (they should have dismissed it for inactivity). Can my husband simply file a motion to dismiss his original petition (that what he wants to do) and we still be legally married? and can our interlocutory decree of divorce (temporary, right?) be reversed since we never had a final hearing, and no final decree of divorce from a judge.

Are you asking if someone can say no to a divorce petition? I am confused on what you are asking? I am wondering if this person was served divorce papers and declined them and now you are wondering what to do?
