CAN WE CLAIM AS DEPENDENTS?

MY DAUGHTER AND 2 GRAND-CHILDREN HAVE LIVED WITH US SINCE MAY. SHE DOES NOT PAY US ANYTHING DUE TO A WAITRESS SALARY AND TIPS (WHAT TIPS LATELY). SINCE WE ARE PAYING ALL EXPENSES OTHER THAN SOME FOOD AND I CAN NOT PAY FOR FORMULA AND DIAPERS ECT... DUE TO MY HUSBAND HAS BEEN OUT OF WORK SINCE AUGUST. CAN WE CLAIM EITHER OF THESE CHILDREN AS DEPENDENTS COME JANUARY? THE FATHER OCCASIONALLY GIVES MY DAUGHTER MONEY BUT NOT EVEN CLOSE TO 28% OF HIS INCOME. THEY DO NOT HAVE ANY PAPERS DRAWN UP BECAUSE MY DAUGHTER IS FILING PAPERS WITH COUNTY FOR CHILD SUPPORT PAYMENTS.  WHAT RECOURSE DO I HAVE OTHER THAN CHARGING MY DAUGHTER RENT.

yes you can but do it before she files for child support.

The short answer is, yes, you can claim them as dependents as long as: 1) you have provided at least 50% of their support through out the year and 2) neither of their parents claim them.  However, it also depends on their ages and whether or nor either are full time students or have part-time jobs.
