Tax Problems

My ex to be and I agreed to file taxes seperate for 2007 tax year. She filed jointly after I had already filed single, she recieved refunds and stimulus payments in my name. I owed , so I paid what I owed. I would have never known until we supeoned her records . So any suggestions ? Guess she did'nt want to pay.

if you didn't have a court order stating file seperate she is under no obligation to do so - regardless of e-mail correspondence. How can you prove you didn't agree to it verbally to file joint?

Long story short it isn't tax fraud.

 

you have to ammend your tax filing.

From other advice I got, it's called tax fraud. Knowingly filing a false return, for gain.

i don't know the law here, but my lawyer told me that any personal agreements, written or oral, meant nothing at all to the courts.  i would get this stuff in writing now for years going forward.

We are in the process of divorce, this was agreed to by us.I have e-mails where she confirmed we were filing seperate.No court orders were in effect to do it one way or another, just agreed on by us to file seperate.

you need to get this in writing and signed.....preferably with a lawyer.  she can't go against court ordered paperwork.  and if she does, she's in contempt.  right now she can just claim she forgot.  was it in your original temporary orders?
