Reducing alimony

Current husband is making (which I contribute to) a large month alimony payment. (also paying child support in addition to alimony) We both work but with the troubled market we are now paying from our equity line of credit. We are at the point of bankruptcy, house is for sale, etc. I have been keeping my mouth shut on the issue. My husband is adament that the alimony cannot be reduced because in the divorce settlement is was stated to be non-alterable. If your income, investments, and net worth decrease because unforseen changes in the financial markets can you petition the courts for a reduction in alimony?

If his income has changed, he can petition the court.  I just talked to my attorney about this today because my soon to be ex has very up and down pay due to his line of work.

Income change (and it has to be more than a 20% drop from previous) is the ONLY actor that could cause a change in alimony or child support.

Your investments, net worth - don't come into consideration.

usually if things change with employment and your income from your new job is less, you can petition the courts to reduce your current financial support.  i'm not sure if that applies to stock market income as well.

and i don't know about the non alterable stipulation either.

sorry, wish i could help more.

has he tried talking to his ex about this? maybe they can work something out without having to call in lawyers/courts?
