Fathers rights while in prison

My sons father has been in prison for over 2 years.  We are not married but due to the nature of his actions, drug use and bi-polar i want to file for sole custody.  Will this be difficult to do?

Yeah I am going to talk to an attorney, I nned to make sure i cover everthing correctly.

have an attorney handle this - don't do it on your own - jsut to ensure you are better protected in what you want.

he could delay it to when he gets out then and be able to have rights to the child - even if it is supervised...

Not exactly sure, he just got another charge against him after 2 years....  Its from 6 months to a year.

Thank you for your reply.

 

He is on the birth certificate as the father and lived with us until my son was 3.  I have been supporting him for the last 3 years since his dad was arrested.  

So i would just have to have it drawn up and have him agree to it?  If he does not make things easy would it be too difficult with his background to get it granted?

other than getting him to respond to the petition to start with - no.

Was he ever even established as the father legally? because if not, you have sole custody by default.
