disability question

ive been married for 24 years, now i have been diagnosed with ms in the state of ohio what are my rights with this disability? how long will i get spousal support, i have no income, i cant work because i cant walk? he retires next year and will i get some of his pension, 401 k plan?

I was told the Ohio formula is 1 year of alimony for every 3 years of marriage.  I was married for 17 years and got 5 years of alimony.  It might max out at 5, though.  I can't remember for sure!

In that you are disabled your spousal support should be permanent - but how much it is will depend largely on what he earns - and if he is retiring next year it may mean all you are going to come out of this marriage with is a lump sum payment that you will have to figure out how to live on.

Honestly, you need to meet with an attorney - you might be in a situation where you can't afford to live if you get divorced...

I can't understand from what you wrote in your "my story" why you are thinking of divorcing...can you elaborate so maybe I could offer you more information?

please check the white box on this page with state divorce laws to confirm...but that amount of time married usually means an equal 50/50'ish split of assets/debts, etc.

so, yes you should get alimony....do you have children under age?...if so, child support as well.   but how much depends on how much he earns.  your portion may not be enough to live on. 

you will probably have to reduce your living expenses and find an online job...or telemarketing sort of thing...something you can do from home perhaps?
