Our divorce date was to be on Sept. 23rd. My stbx for what ever reason did not have everything lined up for mediation to happen before then. I talked to my attorney and ask her for a postponement 2 days before that date. (Judge ordered mediation)

Now here we are, with the next court date on Dec 23rd looking like we are down to crunch time. I have everything done on my end, and am wondering what will happen if he still hasen't got his end lined up for mediation

My ....?... is, if it just goes before the judge on the 23rd of Dec. will the Judge realize that it was not me that 'bailed ut' of mediation but him? And if so, isn't that to my advantage? I wanted to settle this between the 2 of us, and not put it into the hands of the judge without at least trying to come to an agreement.

They both have excellent points.  Don't give an inch.  My ex and I were able to come to an agreement on most stuff and I believe that the judge was fair. When I filed for divorce my atty didn't hear anything from my ex or my ex's atty for about a month.  We didn't know if he had an atty or what.  For us the whole process was only 6 months, however, it could have gone faster if  he didn't drag his feet for the first month.

Honestly, mediation being rescheduled or not even happening is a common occurance and doesn't really affect the case one way or the other....how things are split by a judge is done according to law...it wouldn't be any different than if you went to mediation and didn't agree to anything anyway.

If the two of you can figure out how to meet up and discuss things and agree to some of it so there is less for the judge to figure out, so be it - but if it doesn't happen - it isn't that big of an issue.

Judge could even send the four of you (you two and your repsective attorneys) into a back room on the court date to mediate right then and there before he will even do anything with you.

Caution:  They have set the date for a few days before Christmas for a reason. You will be more vulnerable to any settlements during that time of year.  And remember ... the person delaying is the person who will prevail. Almost never fails.
