Can Ex-spouse take kids out of state for visit?

can ex-wife take my 2 kids out of VA. we both have joint custody. she wants to take them to visit her boyfriends family. but i don't want them to go. we don't have anything in our divorce papers that stipulate any visiting out of the state. I didn't think she could take them out of state w/out my permission. If she did, isn't that considered kidnapping? Any advice would be greatly appreciated. I have only 1 week til she leaves for Md. to visit her boyfriends family......

I am in delaware and in this state either parent is required to let the other no of any out-of-state trips. That would include time of depart. and return as well as address where they would be staying and a number for them to be reached. To me that just seems like the right thing to do with out a law telling us so. Unfortunately, it always cost money to argue these things. Hopefully, you can trust that they are going to be safe. I hope that if you were to ask for this info that they would understand that it is because you as their parent deserve this info and are requesting it for your love and consern for them.

it's odd you don't have something in your divorce decree about this. but i have to agree with lori, unless you fear for their safety or something. going forward, you can request that your lawyer amend your decree and add language that states you have to have written permssion to go out of state...if that will make you feel better.

Why dont you want them to go?? Are you worried she wont bring them back or is it a jealousy issue? You need to consult with an attorney. I think, if its her time with the kids...unless its stipulated that she cant take them out of state, she can do it. If you feel your children are in danger by going with their mother, Id take it to the next level. Although, im not sure what you could do on such short notice. However, if its her time with the kids, then let them go. You will always be their father. This is all a part of divorce. Dont make it harder on the children than it needs to be.
