Financial items in Divorce Decree

My exhusband and I were divorced in April. Per our divorce decree, I was to get an account being held at a brokerage firm. I was also awarded several rental properties and had to refinance them. I have attempted 3 times to refi them but have not been approved because I took out a signature note to buy my home which is guaranteed by the account at the brokerage company. My husband has refused to release this account to me, thus I cannot get the signature note paid and it shows as a huge payment (it is a note due in full) on my credit. He has caused me an immense amount of problems along with the time I have spent getting this resolved. Is there anything I can do?

of for hecks sake, you don't need an attorney to file a contempt motion and if it is written in your decree that you are supposed to get the account, then he is in clear violation of it and there is nothing to "fight" over...honestly, that attorney didn't want to take your case and he inflated his retainer to get you to go away.

Look at your court's webside and see if they have a pro se self help section and downloadable forms - look in your yepplow pages for a paralegal service if you want help with filling everyhting out for a small fee - and get the money you are due.

I was stupid and we did a joint divorce with only 1 attorney.  I assumed (and you know what that stands for) that this would be an easy divorce since we had agreed to everything before hand. I have since talked to a local attorney and they said well, you came out pretty good, I wouldn't fight him.  He told me it would be $2500 retainer and then more and asked if it was really worth it to fight him over this!  He has basically just about broke me financially!

Your only recourse is to take him to court for contempt for not releasing the account to you & request sanctions against hom for the time and money his breech of the agreement has caused.
