What do i get

In Oct.1999 i started a 401k for my kids and in Aug. 2003 i go married we separated in May of 2007 . and now my ex wants half of my 401k to me i think that this 401 k belongs to because i started this way before i married her.

this happened to me. depends on teh state you live in. my ex wanted and could get half of my 401...even though he contributed nothing to it naturally. that's the law here.

A friend of mine was in the same boat as you her spouse was seeking money from her 401k the ask if contirbutions were put into the account by him and the answer was no. The told him that he was not intilted to her 401k because he didn't put money in the account it came from her pocket and hers alone. And they were together 13years this past May. If they didn't contribute to your 401k they shouldn't receive a dime.

the amount pre marriage belongs to you. whatever you contributed/earned post wedding day, gets split.
