help

My wife cheated and now wants a divorce. I also want the divorce. She wants it now and I want to wait until we can be civil toward eachother so we can come up with an agreement. We are going to do this without lawyers If I don't show up for the hearing will she be able to take my daughter from me? We are both fit parents and she claims that she wants it to be a no contest divorce with us sharing our daughter.

fatally - I hate to be the one to break this to you - but you aren't going to be civil with each other until sometime AFTER you are divorced. The longer you hold off, the less civil things are going to get. Just get getting it started over with.

I find it very troublesome that you are considering going through a divorce where custody is a factor without an attorney. Even if you go for a collaborative divorce (http://www.collaborativedivorce.net/)...you should at least have your interests represented. There is a lot to consider when it comes to custody, it isn't just who gets her when, and even with that you two may not be in agreeance on.

and yes, if you don't show up at court, she can get a default judgement against you that will be hard (and expensive) to change.
