refinancing and home equity loan

ok I will try to give short version.  Been married for 10 years and started divorce proceedings. custody is all set. Having difficulty with health ins. he wants toboot me from his even though he is paying family plan. I am finding out about refinancing our home. I can swing the paments.  We also have a home equity loan in both our names that I will take over. qu is, when I "buy him out" do I deduct half of home equity loan that he won't be paying  from the "buy out money?"j

on the insurance - he doesn't have to pay for you after the divorce, and in fact, if you want to stay on his insurance it would have to go through COBRA and YOU would be required to pay for it.

On the HEL, if you are taking it over, that means in it's entirety - so no, you do not deduct anything. You two have to come to a seperate agreement on how to handle the HEL, if he will split it with you and how he wants to pay it if he does agree. It is a completely seperate animal from your mortgage/home.
