sale or buy out of home

My husband purchased the house we live in 4 years before we were married, we've been married for almost 6 years but living together for 8. My name has been one the house from the start of our marriage. I would like to sell the house but my soon to be ex wants to keep it. Fine, but he has to buy me out, right. Pay me 1/2 of what would be left over after we sold the house and paid whom ever their %. Even if not for the 4 years before, but definitely I'm entitled to something for the time I've been there and paying into the house. I've worked the entire time we've been together, in fact I currently work three jobs and I'm a stay at home mom of a two year old boy. I really appreciate any advise to ease my mind. I will need part of that money to put a down on someplace else.

In my opinion and experience he will have to buy you out of your half of he house. Double check though with your attorney.

Yes, he needs to buy you out but that should be stipulated in the court order. I dont know if he gets more of a percentage because he was there first but I wouldnt think so. Consult with an attorney about your rights. The bottom line, however, is that it will be up to the judge.

I would say yes. However, contact a lawyer where you live. Each state is probably different. I am in Canada and in Canada, the answer would absolutely be yes since your name is on the house.
