Caught cheating, won't leave house

This is the second time I caught him. Thought moving to a new state, fresh start would help. Nope. Now I just want him gone. He has no connection here and would have to move back to California, but til then, he is making my life miserable. He will lose his job because I will not take him to work, and even if I did, he wouldn't give me any of his income. So I am paying all bills. Any way to get him out??

I think that Trisha gave great advice here.  Seeking an attorney before you do anything will be able to tell you where you stand on this issue.

Is he on the lease or mortgage? You really need to see an atty. before you take any kind of action. What state are you in now? Go to the white box in the upper right hand corner: state divorce laws and calculators. See what your new state has to say about residency requirements and what you might generally be entitled too.
I think you might be better off for now if he is working. One of the things you really should discuss with an atty.
