With the time that has passed with them living together and the kids being there I am not sure what -if anything that you can do.
Check with your lawyer...is the morality clause in your agreement ? You may be at least able to make him move with that...or maybe , if you have a placeof your own, request that you be granted custody because of her living arrangements.

you have no legal right or reason to request a drug screening for an ex's significant other. If you don't have any evidence - then there is nothing you can do.

He either has to be arrested for a DUI or posession of drugs for you to be able to do anything about it.

Is there such thing as a child custody investigator?  I'm not sure of your state laws there though.

Well you can either go back to court and ask your attorney if you can request a drug and alcohol test for him and the reasons why or you can call DSS.
