money matters

I am going to be filing for divorce. I work for my husband, for little pay. less than 650.00 this year alone. We have 2 houses we own free and clear, (no mortgage) that are rented. Does he get to continue collecting these rents until the divorce is final, or can I have one of the renters start sending the payments directly to me, only?

to add to Ken's answer:

you do not have the right to arbitrarily tell one of the renters to send the payment just to you. That could land you in some hot water in court as it is joint marital income.

However being that it is JMI, you do have the right to request such an arrangement in your first mediation and see if he agrees to it.

I strongly suggest that you get a lawyer involved in planning for your divorce and in negotiating with your husband.  You may well have a right to some of that property (or to the income from it) in the long run, but in the short run it could be difficult to ensure that you get enough cash to meet your living expenses.  A competent attorney should be able to help you map out a course to get you where you need to be.
