Mentally Ill ex daughter in law

My son divorced in January, two small boys.  His ex wife is mentally unstable and has moved 6 times with the kids since April, drifts from house to house with them in tow.  Quit her job in April to go on vacation and hasn't worked since.  My son pays more than his required amount for child support.  Ex wife calls and harrasses him constantly, threatened to kill him.  She filed a false restraining order against him and is now temporarily keeping his kids from him.  She has been baker acted twice recently and goes to the emergency room almost daily with "panic attacks"  What can my son do?

Without knowing what the custody agreement is now it is hard to advise anything. If she has sole custody his options are limited.

 

Please repost with what the custody is. (sole, joint...legal/physical)

What is baker acted?
He needs to talk to his lawyer..with documents in hand of all the crap she is doing. That is not a stable enviroment for the children. Is she bipolar? It sounds as though she is!
Talk to social services and they can direct you on where to go. But I would talk to a lawyer first!

Maybe he needs to get child services involved to check into the stabilty of the mother. The will check out any allegations and make sure the childrens home life is a safe and stable one. It may sound like an extreme thing to do but when the safety of the children is involved nothing is too extreme.

Can he report her to the for Abuse to him or the kids?  This all needs to be documented.  If she is not safe to be around the kids then he should have the state look into this.  Does he have joint custody?  If he could get full custody then the child support payments would not be an issue.  You are a great mom/grandma,  keep us posted.  We are here for you.  There is an Abuse Hotline number on this page, they can give you good advice.
