Temp Orders Denied

My petition for Temp. Orders were denied. My atty filed so they were done right. She said the court has the right to deny them and not justify why. Does anyone know what criteria are used to deny/approve them? What recourse do I have if my husband doesn't pay support for the next 3 months?

if the court finds your request unreasonable based on the other party's financial situation a temp petition can be denied. It's judicial discretion - so what the criteria is varies from court to court.

you need to have the attorney revise the petition and re-file.

What exactly was it that you were asking for? I know that generally, the petition asks for reasonable child support, joint custody, attorney fees, health insurance, etc. I've never heard of them being denied--well, my ex's were, but he was asking for everything under the sun. Plus he was an abusive alcoholic. I'm not sure what to say; I'd seek out an attorney's advice on this one.

Humm I really don't know but you should post this in legal answers....I have never heard of this..I will be anxious to see what answers you get!
Has the support at least been court ordered?
