Need an Attourney

I am planning on a divorce from my husband of 17 years. I am entitled to part of his retirement pension money. This is all I am asking for and he worked for General Motors our whole marriage. He is suggesting a dissalusionment but I am afraid I can't trust him with my future, I am 58 and need to take care for myself. I don't have the money for an attourney at this time is there any way an attourney would wait to be paid until after the divorce? Or have my husband Pay? Appreciate any answers. Thanks

i believe you can reply with a request for more time.  given that this is the holiday season, it's not a ton of time to find and hire a lawyer and respond correctly.

Thanks All for the answerw.  Since that last post I have received a summons along with a ex parte restraining order?  It has some statements on it that are not true.  I have to reply by 28 days.  Hope I can find an attourney before that as it states if I don't reply then all he asking for is by default his.  Wish me Luck!!!!

You will be entitled to something I am just not sure how much.  I would shop around for attorney's that will let you pay after the settlement.  He will then fight harder for you so that he is paid.  Good Luck to you. Keep us posted.

Not an expert, but most lawyers want payment upfront. I think it is a matter of shopping around and most of all if a lawyer/attorney says no, ask them if they know a lawyer who will collect after settlement. No harm in asking for a referral, no cost in making a ton of phone calls.

A collaborative lawyer looks at the whole financial picture and makes a recommendation, but they work for the person who hires them. But, if it is a no fault divorce it might be the easiest and cheapest way to get through the mess.

Most of all, do this for yourself. Once you do get a settlement, either in alimony or retirement $$$ make sure you consult a financial advisor on how best to invest this money.

Why? Many women who do get alimony or retirement end up going through it too quickly and have nothing to live on come 65. Some women who get alimony spend it all as it comes in, then if the husband loses his job - they are stuck with reduced alimony or none!

Make sure you ask questions of your financial advisor. I'd give you a website to go to that could tell you what questions to ask, but I don't want to be accused of advertising.

Take care- good luck.

I have seen it both ways...that the ex at least helps to cover expenses...and they make payments. Do not trust your husband with this on your own. Search for an attorney that will work with you..
As for the retirement...I think that yes you are entitled to at least some of it...I know my bf's ex was paid a certain amount for what he had.
