Adultery
My wife moved out of the house. We are not legally seperated but I was wondering if I could get involved with anyone else without being charged with adultery. She is not willing to sign divorce papers.

How do you get someone to sign the divorce papers? I did not think this would be a problem because she left me. What do I do to get a divorce??

I would say no...wait..not only could she scream adultery but it is better for you to wait because of a rebound relationship. I know it is hard but wait at least until the divorce is final. Some say even a year after that!

Try your best to stay single until this is all over. You do not want to jeapordize anything at this point especially since you are in a "fault" state. Keep everything moving along and you will have all the time in the world to date around. Also, do not think you can sneak around, because I am sure your ex will be checking up on you to try and get more out of you. Good Luck and keep us posted.

Thanks Paula. My wife will not sign papers. I have talked to lawyers and they said I do not have grounds for divorce. I guess being unhappy and fighting every day is not enough. So I would have to wait a year to be with someone so i can get grounds to divorce her?? That does not seem fair. She is the one that moved out.

Yes, it is. If you are not divorced and you have sex with someone who is not your wife, that by definition is adultery. If you have a sexual relationship with someone in a fault state, and your wife finds out about it and can prove it before you have a legal seperation or divorce in hand, you will be made to pay...big time. Wait until she signs the papers, is my advice to you. If she loves you, she'll understand...and if she leaves you, then she wasn't the right one for you.

Thanks Paula. I am ready to start a relationship. I live in a fault state. What does that tell me about my previuos question?? Is it adultery even though we do not reside together??

Agreed with Paula...a lot depends if you live in a fault/no-fault state. But, even with no fault state, conduct like adultery can impact the settlement in favor of your stbx, so I would be careful. You probably won't lose your shirt, but I wouldn't take the risk of losing anything, but that's me.
