Medical insurance held by spouse

My spouse holds the medical insurance and she has applied to have me removed by Dec. 31st. Is this legal or does she have to keep me on insurance until the divorce is final?

Not sure I will be going through this also, I would ask in divorce papers or see if you ca get a cobra Ins al though it will be costly. Good luck Maybe ask her to keep you covered for one year and pay her the coverage cost.

Most employers do not allow changes to medical plans unless it is the enrollment period or a qualified change in family status. Divorce is definitely a qualified change in family status but the final paperwork is needed to prove this. If it is open enrollment, she can make any changes that she wants unless you get a ruling that she has to cover you until the divorce is final.

If you have already gone to court and a judgement is made, she can do what she wants. Of course, she can do what she wants with or without a judgement anyway, its just a matter of whether you want to fight for your right to stay on the insurance enough to take her back to court or if you want to just get your own insurance and not bother with the headache.

Check you original served Divorce papers. There should be a copy of several papers stating no really changes can be made to just about anything. May have a specific statement about such things there.

I am not sure, but I do not think she has to keep you on her insurance unless it is agreed upon in your divorce settlement. Have your attorney work this into the agreement if you need this and are unable to get this from your employer.
