Is the diamond engagement ring marital property???

I got my engagement ring  as a christmas gift.  He has put it on his financial statement as marital property.  It's mine..right???

if you two have it insured - then it becomes marital property "sortof"...the argument your attorney will bring on it is that it was given to you as a binder to a contract (marriage) that contract was fulfilled by you, making it your legal property.

I'd say it's yours whether or not it was a "Christmas gift". Just like his wedding band (if he has one) is his.

If you don't want it (likely), you should be able to sell/hock it and keep the money.

If he wants it for his next honey, he should pay you for it in the settlement (he gets the ring, you get more $).

Only possible exception would be if it is a family heirloom from his grandmother or something. And I'd still say you should get fair market value for its return.

I would say yes it is yours. Is he asking for other gifts that he has given you also.
I guess you could say ok..I will give it to you ..but I want all the gifts back I have given to you . Then give him a list. See what he thinks of that!
My guess is he wants to hock it so he can have the money.
