cookster

My ex-husband smoke "maryjane" and that was my biggest problem. We argue so much because I did not allow him to smoke inside the house and it was affecting us financially. 

He did what he wanted to do and anything I say or do he would just completely ignore it. So, I pretty much did not have a choice. I would like to bring this to the judge attention but Im afraid. help,advise.

that won't fly in california....you ave to have a reasonalble basis - and prior use over 4 years ago, won't cut it...

Have you considered asking your attorney to request drug testing for both of you as you are concerned about his past and current drug use?

Actually, he was caught in the past and he does have a record. The police stop him and found MJ in his car. Im not sure how long ago but I think 4 years ago. Would that help me at all and would that still be in his record?

if he has never been arrested for it - you have no proof unless he stupidly admits it in depostion - SOOOOOOO, it will be she said he said, meaning he will say he isn't a drug user and you will say he is - and if he has no record (criminal) that would back up your allegation - it won't get admitted in court - nor will be be forced to do drug testing.
