is it revenge?

I been married for 5 years and out of those 2 years we are seperated i filed my divorce,and the waiting period is over.since we were separted i filed and got full custody of our son and she pays for child custody(well suppose to she does when they are about to put a warrant out for her).now that she is behind she went and filied for spouse support again, 2 years ago she filied and never showed to the hearing so they threw it out the window.i make about $36,000 a year,live in pa,she been in and out of trouble for drugs got arrested for selling,she is living with another guy,has her own apartment,she can't keep a job,our hearing is in november,and my divorce should be finale in september.We own no property together...would i have to pay her?

Hi Pyro.  I think you are relatively safe on this one.  Although she appears to have a drug problem and may not be able to keep down a job, most judges are not going to that as an excuse to claim spousal support.  And as the others mentioned, the relative brevity of the marriage (5 years) makes spousal support unlikely.  Worst case scenario, the court may allow some support for a short period of time to allow her to get job training or something, but I believe you have a good case to avoid it.

You have the kids , you shouldn't have to...keep track of the trouble she has been in and her inconsistancy to show up to court.

seems unlikely to me that you would be required to pay spousal support if you have the children and were only married for 5 years.
