waiting a year

If the two of you live under the same roof but do not have sex for over a year do you still have to be out of the house for a year to get a divorce?

My understanding is the law is different in each state. In GA you are allowed to cohabitate in the house as long as you are not having sex. If you do have sex it re-starts all the timers. In my county you can be divorced in 30 days.

I live in S C. You still have to live out of the house for a year. S.C. doesn't use just sex as co-habitation. Co-habitation is living together in the same house and doing the same things you did together. Being in the house alone for extended periods of time, going out to eat, attending functions, etc.

If one of you comits adultery and it can be proved you can get your divorce in 90 days.
