how come a stay at home dad doesn't have same rights as stay at home mom?

I was a stay at home dad for almost 6 years gave up a career at a college to take care of kids all of a sudden she decides she wants divorce tells me to get out. Now the mediator is telling me that i have to pay child support even though she is going to make at least $95000 this year and I still don't have a full time job. Can someone give me advice on this?

The kids are still your responsibility even though she makes more money than you. They will base the support on your income so be sure to show proof of expenses as well. Just because one parent makes more than the other does not mean that the other parent shouldnt support their kids.

The mediator must be basing this on your last job and income. I think they go on the assumption that you will make what you made before. Doesn't matter how long you've been out of work.

Don, I am no lawyer either, but i do not believe the mediator is binding, plus since the roles in your situation were reversed from what might be considered traditional, you may be entitled to alimony, or at least your wife may have to pay some sort of spousal support until your able to re-enter the work force. Also child support varies from state to state, in Florida I believe it is based on income, and usually the person with whom the children do not live has to pay, based on their income.

Im no lawyer, but i am under the impression support is need based. if your soon-to-be ex has a high paying job and you are unemployed, not sure that reflects "need" either there is something you left off, or you need a lawyer asap.....
