Out of State Divorce

I live in Oregon but my marriage took place in massachusetts. How do I go about getting a divorce in this situation? Do I need tog et a lawyer in Massachusetts if I can not make itt o the court hearings?

I doubt he would protest because we have nothing to fight over.. The easiest way that we can get this thing over with, the better. Im having trouble getting him to sign the papers here in Mass, just because he is too lazy to go out and get his signature notarized. If I file in Oregon and he does'nt file a responce, will I still be able to get a divorce without having to go back to Massachusetts?

Yes, but since you recently moved, more than likely it will get forced back to Mass...if you are in Oregon for 2 years, then you'd have the right to file there and not be subject to a jurisdictional dispute - but a few months to a year...your spouse has grounds to protest - especially if they have never stepped foot in Oregon.

My Spouse still lives in Mass.. and I just recently moved. So, If I have residency here in oregon, I can file here even though the whole marriage took place in Mass?

is your spouse in Mass & you moved? Or are both of you in Oregon?

If you have been in Oregon long enough to establish residency, you can actually file there - but if your spouse is in Mass, they can counter file in Mass citing jurisdiction because you lived there longer and recently moved.

If the proceeding stays in Mass, or gets filed there - yes, you retain an attorney there and will have to travel - HOWEVER, if your spouse files, then you will be the respondent and won't be subject to showing up at every hearing, if you have legal representation. But you are going to have to show up a couple of times at least. As the petitioner (the one who files) if you don't show up, even if you have representation, you can subject the other side to the allowance of a default judgement in their favor.

If you both are in Oregon, file in Oregon, it doesn't matter where you married at.

if you do have to deal with two states - I have one word for you - SETTLE.
