NEED HELP

Can I get an annulment or do I have to seperate and then get a divorce? I live in NC and have only been married for 3 mos. No kids involved. We rent and the lease is over. He cheated since the day we said "I do" and we both agree to end the marriage. I need advice! I'm only 22 and this is so new to me.

I checked the NC state statutes and apparently, you are going to have to get divorced - NC only allows annulment if you married a first cousin, lied about your age & are a minor, one is impotent, or one party is legally insane and had no idea what they were doing.

apparently marrying a felon without knowledge of his crimes isn't something you are allowed to erase from the history books in NC.

I did find out right before we were married that he had been in trouble but it wasn't til after the marriage i realized he was a convicted felon and had been in prison several times. Does this help with getting an annulment? Or should I just have been smarter in finding that out before marriage?

Usually an annulment is only given for extreme circumstances -- you discovered someone was a convicted felon and never told you, he or she had a double life, they were arrested and convicted while you were married. It doesn't sound like your circumstance lives up to that. I would say you might try a dissolution, which is having both of you agree to who gets what and filing the legal paperwork yourself, which will be less costly. Usually your county's family court can point you in the right direction. There are stories on annulment process and do it yourself divorce on the site. Just search for them. Good luck.
