My husband is trying to force me to agree to sell our home. We have one child. He's 8 y.o. We are in the middle of divorce. For the downpayment for the house and legal fees we used my husband civil lawsuit setllment money. The money was deposited on our joint account. Later on it was subtracted (?) from workers comp compensation if it means anything. What are my rights? I don't want to sell. We bought it in 2007. I paid the mortgage for the last 12 months.

The only way you can keep the house is if you can prove to the judge that you can refinance it into your own name and pay for it (not including child support payment in that calculation) as well as buy him out of his share of the equity on the home. (It doesn't matter who paid the mortgage, marital funds were used - who's check it came from is irrelevant - it also doesn't matter how the house was purchased in the first place. 

If you for any reason can't do the above, you will have no other recourse but to sell.
