Is it abandonment (in california) for a mother to leave the house?

what does a mother do when the father won't leave?
He works 12 hr. days. I am a stay at home mom of 2.
Makes sense that he leaves since he's rarely here, but he won't. He handles the stress far better than I. After 6 months of a cohabitating separation, and nothing has gotten better, it's time to move on, at least for the summer and then re-evaluate in the fall.
But he won't leave. Holding on to sanity.
Any advice would be nice!

I would seek legal advice but make sure you are open and honest with him, make a plan.  If you leave tell him where you are going and make sure everything is out in the open.
